The Alabama Supreme Court upheld a Summary Judgment in favor of HSCBPA’s client Avondale Brewing Company LLC in a wrongful death case.

In their complaint, the decedent’s family claimed the brewery over-served the deceased in its tasting room before he was killed in a motorcycle accident. Plaintiffs also alleged Avondale’s craft beer was an unreasonably dangerous product because it had higher alcohol than traditional, non-craft beer. Tristan Armer, on behalf of Avondale, moved the Court to dismiss the case because the Plaintiffs were not actual dependents of the deceased and the beer was not unreasonably dangerous under Alabama Law. The trial court agreed with Avondale, and entered a judgment dismissing both claims.  On February 12, the Supreme Court of Alabama affirmed the dismissal without an opinion.
