Firm Wins an Appeal for Client at the Mississippi Court of Appeals

HSBA-PA Attorneys Tristan R. Armer and Myra A. Cunningham represented the Employer & Carrier in the appeal of a denied worker’s compensation claim.  The case involves the ‘coming and going’ rule, exceptions to the rule and the fact test of deviation.  Mr. Armer defended the employer and carrier in trial before the Mississippi Workers Compensation Commission and obtained a favorable decision for his clients.  Mr. Armer and Ms. Cunningham then briefed the case to the Mississippi Court of Appeals after the claimant appealed.  The Mississippi Court of Appeals affirmed the denial of worker’s compensation benefits 5-4.  The full opinion can be found here:  MS COA Opinion    The case was reported as a case of interest by Business Insurance e-zine:  Bus.
